“In all of my 35 years on the bench, I have never sentenced anyone to probation on a Mandatory Sentencing Structure.” This statement from Senior Judge W. Earl Britt from the Eastern District of North Carolina, during my client’s sentencing hearing, confirmed the compassion and strength that I know is needed to defend a person against an investigation or accusation from any governmental agency. The desire to excel in providing individuals with the highest quality of legal representation is my motive for each client that hires our firm.
I have intentionally devoted my career and solo practice to vigorously fighting for a person who is being investigated, charged or indicted by the state or federal government. As the managing partner of Herring Law Center, PLLC , I use my experience and education to be faithful to the representation of the indigent through court appointed work from the state of North Carolina in Cumberland, Durham and Wake Counties. I have had the opportunity to fight for the best possible outcome for over thousand clients in state court including negotiated dismissals and plea bargains, jury trials and argued on criminal appeals. Through the commitment of effective criminal defense and reputation for achieving positive results, I have gained the appreciation of clients, their families and colleagues.
In 2017, I had a successful jury trial against one of the Wake County Police Officers who charged my client with Common Law Robbery, Assault with a deadly weapon on Government Official, and Assault with a Deadly Weapon. The officer was aggressive with my client but my client held his composure by keeping his hands raised at all times during the beating. Providing the jury with dash camera video and persuasive cross examination testimony from the officer, the jury found my client not guilty of all charges within 30 minutes.
Also, I am a member of the CJA Panel in the Middle District of North Carolina which covers Durham, Alamance, Greensboro and Winston Salem. I have represented many indigent clients through the panel and private clients through the last 10 years. Through the appointments to defend those indicted of federal charges is where I excel in the courtroom with impressive results through mitigation and deconstruction of the Federal Sentencing Guidelines. With challenging issues and undesirable results from the District Court, clients have appealed which provided the opening for appellate representation. Through appellate representation, I have filed briefs and argued orally before the Panel of Judges at the 4th Circuit Court of Appeals. This level of representation has driven me to understand Mr. Stephen Covey’s tip: “begin with the end in mind.”
Not only have I developed my skills through the courtroom but I have purposely earned CLE credit through the Federal Criminal Seminars that are held annually by the Eastern District of North Carolina. I also attended the Sentencing Advocacy, Trial Skills Academy and the Fundamentals of Federal Criminal Practice hosted by the Federal Defender Services Training Division. Through Gerry Spence Trial Lawyer’s College, I obtained a certificate of completion for the 7-day in depth Death Penalty Seminar. All of these training opportunities is where I have learned the importance of treating each client with the respect and dignity that he or she deserves.
As a successful business owner, compassionate advocate, and aggressive defender, I know that I will represent you with compassion to gain results. Contact me by phone or email to set up a free consultation.
